In addition, CloudNexus gives domain name service and managed web hosting. It has some ethical and legal responsibilities including the utilization of its servers and the equipment in the services. However, its general policy is intended to act as an internet presence provider. CloudNexus can eliminate a customer’s approach to any of the services given by CloudNexus when the account is not used appropriately.

What is Appropriate Use?

CloudNexus is the web hosting solution mainly intended to serve the web hosting requirements of small as well as solely owned and managed brands and organizations all over the globe. Since you may also have to host your site with other customers on our servers in a basic community, the offerings that we provide are not designed to support large business requirements. In addition to that, we suggest buying at least a dedicated or cloud server solution or virtual private server.

CloudNexus is a shared web hosting service, which means several clients’ websites are being used and hosted within a similar server environment. Although to ensure that our hosting is reliable, excellent, and accessible to all clients within that server community, one person’s website users can not actually impact the functioning of other client’s websites. We manage our sites 24*7. Therefore no single client can affect the functioning of that server. For some reason, Customers can abuse CloudNexus policy and service terms when they or their customers, subsidiaries, or affiliates, including in the below-mentioned activities.

UCE / SPAM

Email violation and misusage are critical issues, and certainly, the CloudNexus server is not going to tolerate them.

This policy contains every domain and server on our network, including bulk reseller, virtual shared, VPS, colocation, and dedicated.

Definition of UCE (Unsolicited Commercial E-mail), or spam:

  • The promotional content, bulk UCE, or some other types of solicitations are delivered through e-mail that promotes any IP addresses related to any URL(domain) that is hotels via the CloudNexus network or CloudNexus itself.
  • Undesirable posting URL hosted by CloudNexus server or newsgroups promoting any IP.
  • The utilization of web pages add-up on ISPs that permit spamming ( are also considered as “ghost sites”), which indirectly or directly point out clients to IP addresses or domains hosted by CloudNexus server.
  • Promotion, transmission, or else making any program, software service, or product available that may be intended to assist a resource to spam.
  • Dissimulating or executing a message header to hide the actual base of the message, whether in half or whole part.

Additionally, because of the expanded risk and issues to our CloudNexus networks, we restrict the usage of third-party mailing lists.

Repercussions of spam:

Generally, it is believed all over the internet that spam is improper and not considerable business practice.

  • Impaction on the CloudNexus server

Spam is harmful not only for the reason of its bad affection on clients’ attitudes toward CloudNexus but also for the reason that it can overburden CloudNexus.

Although there are several groups that block and report the server from where spam is sent. Also, in action, the spam is activated off our client’s or our server, our severe can be blocked, and this may affect other clients keeping our network at risk.

Our Providers:

While it can be unsolicited, customers who get spam generally are annoyed and deliver complaints against us to our service providers. This may upset our providers, who hated spam for similar reasons that CloudNexus does. However, it tends to negative clients' attitudes as well as drain resources. Since we aim to keep positive business bonds in the internet community and certainly will not permit any activities that may abuse these bonds.

Consequences/ Penalties for Spamming:

CloudNexus hold the liability to eliminate the account that abuses this policy without any warning. Making use of CloudNexus services establishes accessibility and awareness of this policy.

CloudNexus may charge $25.00 per complaint for spam we get from any domain and may be charged to the domain holder or the server holder of the domain endure, or the domain reseller. Owners of dedicated servers, resellers, and colocation clients may select to forward this charge to their customers if accurate. These charges are not refundable and are invoiced at the time of the complaint message.

However, it is the duty of the owner's dedicated server, colocation customers, and resellers to operate the email from their accounts and to maintain our policies for complaints.

CloudNexus holds the liability to make decisions of what it takes” spam,” “mailbombing,” “UCE,” or “bulk-mail,” as well as to analyze from all the proofs if or not the email subscribers were out from the “opt-in” email list.

If you also utilize the mailing list, then you must go through the below-mentioned guidelines that are considered as the internet standard statements and best current mailing practices for management and prevention of email violation.

ADULT CONTENTS

VPS, Colocation, and Dedicated Servers

As we can shift the IPs and provide them to the account holder, we also allow our colocation and dedicated clients to have adult content on the server. Additionally, all of the TOS and AUP policies do apply in this, including, but not limited to:

  • Illegal content: Illegal activities are strictly restricted on our network by us, including, but not some certain exploitation of amateurs.
  • UCE/ Spam: These adult websites are influenced to use Spam/UCE as a type of marketing. Before using the services provided by us for adult content, it is suggested to go through our spam policy. It is clearly stated that we are not going to tolerate spam.

Virtual Shared Servers

As the internet has been considered a communication tool globally, and we have customers from every country, it is edited into what is known to be “adult content.” However, it is not our part to be partial against those who use adult-related content. It is also being said there are many reasons that CloudNexus is forced to make its no adult sites policy for its virtual and infinite reseller server users, including direct customers, resold accounts, and resellers.

What does Cloudnexus consider “Adult Material”?

  • Any website whose income is provided in part or all from its adult content.
  • Videos or photos that show nudity, whether women or men, for non-artistic or non-scientific reasons.
  • Hyperlinks to adult websites contain the sites that abuse these policies.
  • Websites that share information and have discussion boards that are “adult” in nature.
  • A website that promotes or sells “adult” content, including adult toys.

CloudNexus holds up the liberty to make decisions about what it considers “adult material,” “ adult content,” “sexually explicit,” or "sexually related.” Although if you are not sure of the acceptance of your website before making a purchase, please let us know.

Why does Cloudnexus have this policy?

  • Bandwidth and Resources

A virtual server is a shared environment where several reside on each particular machine. This is also said that an average adult website can get more clicks than many standard sites. Although some of the small adult websites can have around 5 GB of shifts per day.

With such kinds of resources being used, our servers would be badly slowed if we permitted these huge traffic websites to stay on our servers. Above that, we would be pressured to higher our cost for the additional bandwidth. We aim to keep our server fast and at a reasonable price, as well as clear our bandwidth; as a result, adult websites are no longer an option.

  • Banned IPs

Adult websites tend to be blocked, while most of our shared accounts also share IP addresses, or the limits of the IP address are restricted. All other customers on that network range and server are affected.

  • Association

Many individuals do not need to be associated with adult content grounded on the self's beliefs and opinions. IPs are given to a server in varieties, and IP addresses are also shared in many instances shared IPs. Therefore, we want adult content-free shared servers.

Violation of Shared Server Resource

Our CloudNexus server allows PHP, CGI, Perl, and many other simple processes to host all virtual servers. However, these resources may be resource-intensive, and as a VPS should be delivered to other clients, we must restrict the amount of memory, CPU, disk I/O, database, and disk space utilization that can be done by anyone's profile on a shared server.

As a result, any usage or program with so many resources that affect other clients in either reliability or functioning is seen as resource abuse. Shared servers are “shared,” and the time comes when everyone needs to play fair. Additionally, a customer may need more resources in the event that is sufficient on a dedicated solution, like VPS, dedicated or colocations, and shared server environments are suggested.

What does Cloudnexus Network consider “System Resource ABUSE”?

Any website whose traffic, processes, or programs use many system resources. Yet a large amount is considered as any amount that leads to substantial degradation of the network’s functionality. CloudNexus server is an independent enticement of what degraded server performance constitutes.

However, our many reseller plans have great brand width availability and disk space. These accounts are designed for medium and small-sized traffic loads and websites. The BR accounts are not designed for busy, large resource-intensive sites. Our VPS and dedicated servers are ideally suited for such sites as they do not affect other users. Examples may include:

  • Flat File Database Driven Forums

CloudNexus does not allow the utilization of UBB or YABB bulletin boards because of their utilization of flat files rather than a database. Use of these boards for very active and large forums results in system functioning downgrading and are not accessible in our shared server environment.

  • Background Running Processes

Generally, background daemons are restricted on CloudNexus servers, such as IRC, egg-drop, bots, XiRCON, BitchX, warez sites, or any other program that intrudes with simpler server operations.

  • Cron Jobs

Customers are allowed to add cron jobs to do routine activities automatically. Due to the impact on the server, managing some automated processes can pick up certain server resources, and in these instances, the cron job is disabled by our technicians.

  • Mailing Lists

There is a strict policy related to the use of spam in our network, but we allow the utilization of mailing lists within the suppression of our spam policy. However, delivering a lot of emails off a provided network can affect the server's functioning. As a result, we have limited the number of emails accessing our shared virtual servers.

  • Maximum Email Attachment Size

We allow the maximum email size in our share hosting mail server as per email to be 50 MB.

  • Maximum MYSQL Database Size

Although infinite MYSQL databases are allowed by us, in the server stability interest, you have to try still to keep them advanced, a minimum of 3000 tables or less than the overall of 5000 tables per database fusion of all databases per hosting profile and a minimum of the total 5 GB size fusion all database per account, whichever of them is lower.

  • Archive or Backup Storage

It is not permitted to utilize a shared hosting account as a backup or storage device. This may include videos, music, ISO, archiving electronic files, photos, and log files.

Exploitable Scripts

Miserably many randomly used scripts can be exploited to permit illegal users to our systems. Therefore, we may on the incident need to be restricted as well as consequently hide these scripts. You can go through the most instant exploits on our restricted- scripts pages.

Why does Cloudnexus Network have this policy?

Server fairness and speed to others. One virtual server is delivered, and as such, there are several accounts per system. In all, CloudNexus' network can’t permit 1 or 2 customers to utilize all the system resources on a shared machine, and all other customers on the machine suffer from it. Additionally, using more than 1 customer excessively led to huge slowness in all programs.

What happens if I violate this policy

Every account considered to be using a huge amount of system resources will get a warning via email from the CloudNexus network. This warning may include that the site is making use of excessive resources. CloudNexus network will give choices for reducing the use and upgrading the account. If the stage is served, we can eliminate the process or account certainly to bring the functioning of the server back to an accurate level. If possible, then a day's notice will be given

BANNED SCRIPTS

Valid for the target audience - VPS, Dedicated, Bulk Resellers, shared hosting customers, and Colocation.

Unfortunately, a lot of wonderful things are exploited against us for evil purposes. Scripts that are widely used are frequently utilized as a means of gaining access to systems without authorization. Some individuals simply need more resources than what is available on a shared server setup.

As a result, we sometimes need to take measures that inconvenience our loyal clients in order to protect the security of the CloudNexus Network and servers. We may need to disable scripts or other tools installed and utilized by our customers whenever we discover scripts or other frequently used tools that can be easily hacked or affect other users by consuming too many server resources.

When possible, we'll let our clients know in advance. We'll also make an effort to update this page with the most recent scripts that need to be taken off our network and/or shared servers.

This list includes the script/program names, the cause for the prohibition, the people/servers they are forbidden on (such as our Shared or Network wide), and whenever possible, it offers our clients alternatives.

Banned scripts and alternatives:

Other Activities CloudNexus Determines to Be Harmful

    • Taking part in actions that CloudNexus deems to be detrimental to its clients, operations, reputation, goodwill, or customer relations, whether those actions are legal or illegal.
    • Taking part in activities that we reasonably suspect are intended to misrepresent the reputation and goodwill of another party.

As we have stated, it is primarily the client's obligation to refrain from the detrimental actions already mentioned. As a matter of policy, CloudNexus won't routinely check to see if its clients' communications adhere to the rules set forth by the company or the law.

However, if CloudNexus learns of harmful activities, it may take any measures it deems necessary to stop them, such as deleting data, shutting down a website, putting in place screening software that blocks offending transmissions, blocking access to the Internet, or taking any other appropriate measures.

CloudNexus is also worried about how private online communications and websites can be. The Internet is generally no more nor less secure than traditional forms of communication, such as voice telephone service, facsimile, and mail, all of which are susceptible to interception and other security issues.

However, CloudNexus advises its clients to proceed with caution and presume that all of their online communications are insecure. The information transferred over CloudNexus infrastructure cannot be guaranteed to be secure by CloudNexus.

Unless obliged to do so by law, a governing body, or when there is a threat to public safety, CloudNexus will not proactively monitor private email messages sent or received by its clients

However, CloudNexus has the option to electronically monitor its service in order to make sure that its infrastructure is performing as it should. Additionally, CloudNexus may divulge information in response to a court order, subpoena, summons, discovery request, warrant, statute, regulation, or governmental request. But it is not limited to information about a client, a communication made through our network, or a website. CloudNexus does not have to notify the client that their information has been shared, and in some situations, doing so may be against the law.

This AUP is intended to help Internet users, including CloudNexus and its clients, understand their responsibilities as responsible members of the Internet. To report a client's alleged violation of this AUP, send an email to abuse@cloudnexus.com.my.
